WHAT TO DO

The commonest misconception runs: recognition first, then entry. The law also provides for the reverse order, in two variants.

§ 16d (1) applies where an authority has already determined that you are missing adaptation or compensation measures: you receive a residence permit to complete exactly those measures, including the examinations.

§ 16d (3) applies earlier — the recognition partnership. You need no completed procedure, but a job offer and an agreement with the employer. Recognition and work then run in parallel.

And before you weigh either: if you are over 45, calculate the salary first. The threshold in § 18 (2) no. 5 AufenthG decides earlier than any question about your degree.

The § 16d (3) agreement is often passed along as a standard annex to the employment contract. Read the part that binds the EMPLOYER: they must enable your qualification within the employment relationship. If that is only vaguely worded, negotiate it before signing rather than after arrival.

What is the recognition partnership?

The route under § 16d (3) AufenthG: you enter with a concrete job offer, work in a qualified position and run the recognition procedure only once you are here. The condition is an agreement in which you undertake to start the procedure without delay after entry, and the employer undertakes to enable you to complete the required qualification measures within the employment relationship.

How long does the residence permit for qualification last?

Up to 24 months, extendable by at most twelve further months, with a maximum stay of three years (§ 16d (1) AufenthG). Alongside it you may take employment unrelated to the measure for up to 20 hours a week.

I am over 45 — does that matter?

A great deal. For a first permit under § 18a or § 18b after the age of 45, § 18 (2) no. 5 AufenthG requires a salary of at least 55 per cent of the annual contribution assessment ceiling of the general pension insurance — unless you prove adequate pension provision. This threshold decides outcomes more often than any question about the qualification.

Who counts as a skilled worker?

§ 18 (3) AufenthG distinguishes two cases: a skilled worker with vocational training needs an equivalent foreign qualification, a skilled worker with academic training needs a recognised degree or one comparable to a German one. In the first case equivalence must HAVE BEEN established — that is where visas fail, not on ability.
