FREQUENTLY ASKED QUESTIONS

What is the Ehefähigkeitszeugnis and does everyone need it?

A certificate of capacity to marry from your country of citizenship. Many countries issue it — then it is mandatory. If not issued, you need an exemption from the higher court president, a separate lengthy step.

Home-country documents — are apostille and translation mandatory?

Yes: birth certificate, proof of marital status etc. with apostille and sworn translation. The longest block — start there, not with the registry office booking.

My country does not issue the certificate — dead end?

No: in that case the president of the higher regional court (OLG) grants an exemption under § 1309(2) BGB. You apply via the Standesamt; it takes weeks and the fee depends on the couple income.

Can I translate documents cheaper at home?

The Standesamt only accepts translations by translators sworn in Germany. Foreign translations almost always have to be redone.

How long are the certificates valid?

Usually 6 months from issue. Time your orders so they are fresh at the Standesamt filing — not at the start of collecting.
